Governing Law and Jurisdiction
These terms and conditions constitute a contract made under and governed by and construed per the laws of California. You agree that state and federal courts located in Orange County, California, or the ninth district shall have exclusive jurisdiction to hear and determine any claims or disputes between you and the City of Laguna Niguel (and/or its officers, employees, agents, and the assigns of same), pertaining directly or indirectly to these terms and conditions, or any matter arising therefrom, or any other document executed and delivered in connection herewith or therewith.
Miscellaneous
Except as expressly provided in a particular legal notice posted by the City of Laguna Niguel on this site, these terms and conditions constitute the entire agreement between you and the City of Laguna Niguel concerning the use of this site and its materials. The City of Laguna Niguel’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of these terms and conditions. The City of Laguna Niguel may assign its rights and duties under these terms and conditions to any party at any time without notice to you.
External Links Administrative Policy
The purpose of this external links administrative policy (this “Policy”) is to establish regulations for the operation and administration of the City of Laguna Niguel’s (the “City”) website (the “Website”), particularly as they relate to Internet links appearing on the Website to external websites maintained by third parties (“External Links”). The City’s Website, hosted at www.cityoflagunaniguel.org, is a convenient and accessible channel by which the City may communicate certain information to the public—it is not itself a public forum intended to facilitate or host public discussion. The Website is a non-public forum, intended to facilitate one-way communication between the City and the public. The Website is not intended to, and does not, facilitate general debate or the free exchange of ideas.
From time to time, the City may elect to include one or more External Links on the City’s Website in accordance with this Policy. The City is not responsible for, does not endorse, and cannot assure the accuracy of information on these outside websites. (See “Disclaimer of Endorsement,” below.)
The City retains sole discretion to determine which External Links may be included on its Website and reserves the right to remove any link at any time without cause. Entities and organizations wishing to establish External Links on the City's official Website must submit a detailed written request to the Administration Department (email is acceptable).
The City, through the City Manager or his or her designee, shall review each proposed External Link prior to its placement on the City’s Website to determine whether the External Link is relevant, appropriate, and furthers the City objectives and purposes set forth in this Policy. The City may elect to update one or more pages on its Website to feature the External Link, or may take no further action on the proposal. In no event does any External Link submission or request entitle any person or entity to any response of, or action by, the City. The City is not obligated to notify the person or entity requesting the External Link if and when that the External Link is hosted on the Website, nor is the City obligated to notify the person or entity that the External Link has been moved or deleted. The City will endeavor to timely remove any External Link upon request of the owner or operator of the third-party website to which the External Link directs.
At its discretion, the City may provide External Links to third-party sites that fall into one or more of the following categories:
- Other governmental agencies or quasi-government agencies (e.g., water districts) with the jurisdiction of, or having jurisdiction over, the City of Laguna Niguel;
- Elected Public Officials;
- Local hospitals;
- Utilities;
- Bona fide educational institutions;
- Transportation agencies;
- Local organizations, as defined in the Internal Revenue Code §§ 501(c)(6) and 501(c)(3), that partner with the City to achieve one or more of its strategic goals;
- Organizations with some economic or subject matter relationship to or with the City, its policies, or its programs (including, for example, contractors, sponsors, and participants);
- External Links contained within agenda materials.
The City of Laguna Niguel reserves the right to: (1) deny an External Link request of any person, business, or organization seeking an External Link when it is determined, following review of a request, that the entity or organization for which the request was made does not meet the criteria set forth in this Policy; and/or (2) deny an External Link request to any entity or organization which fails to provide all required information, or fails to provide truthful information.
The City will not link to any external site that is contrary or detrimental to the City’s mission, values, image, and interests, or is otherwise irrelevant. This includes, but is not limited to, websites:
- Promoting or exhibiting hate, bias, discrimination, pornography, or libelous or otherwise defamatory content;
- Associated with, sponsored by or serving a candidate for elected office, any political party or organization supporting or seeking to defeat any candidate for elective office or any ballot proposal;
- Associated with political organizations or other organizations advocating a position on a local, state, or federal issue;
- Furthering the agenda of a political organization or candidate running for office;
- Violating any of the City's equal opportunity or norms and values policies;
- That are individual or personal webpages, blogs, social media pages, or chat groups.
Removal of External Link(s)
The City reserves the right to remove any or all External Links immediately and without notice to any person or organization. The City further reserves the right to revise this Policy without prior notice.
Location and Appearance of External Links
The City reserves the right to determine how and where External Links will appear on its website (i.e., on what page the link appears and where the link is placed on that page).
Disclaimer of Endorsement
External Links appearing on the City of Laguna Niguel’s Website will redirect users away from the City's Website. Please be aware that the Internet sites available through these External Links and the materials that are found at those sites are not provided by, endorsed by, or under the control of the City of Laguna Niguel. Therefore, the City cannot and does not make any representation about these sites or the appropriateness of the materials available on those sites. The fact that a user may be able to access these additional sites from the City's website is not an endorsement, approval, or recommendation by the City of any of these sites or any material found there. The City provides External Links only as a convenience to users, and access to any third party sites is done at the user’s own and sole risk. The City does not exercise any editorial control over the information that may be found at externally linked website locations and disclaims any and all liability for and knowledge of their contents. When a user selects a link to an External Website, the user leaves the City website and is no longer subject to the privacy and security policies of the City.
